'Exemption from punishment for initial violations' highlights the warmth of customs law enforcement
Recently, a private enterprise in Dalian faced administrative penalties for failing to declare inspection of imported wooden packaging. According to the newly revised "Administrative Penalty Discretionary Standards of the People's Republic of China Customs (II)", the Dayaowan Customs under Dalian Customs applied the policy of "exemption from punishment for initial violations" and did not impose administrative penalties on the enterprise. The relevant regulations were educated and explained to the parties involved.
The wooden packaging that was not declared with the goods due to improper operation this time should be punished. The customs will not punish it according to the policies of 'no punishment for minor violations' and' no punishment for initial violations', which reflects the responsibility and commitment to helping the development of the enterprise and enhances our confidence and determination in compliant operation in the future, "said the person in charge of the private enterprise.
The policy of "exemption from punishment for first-time violations" stipulates the list of items that comply with the "exemption from punishment for first-time violations" of customs administrative penalties, or other specific situations where first-time violations with minor harmful consequences and timely corrections can be exempted from administrative penalties, aiming to guide enterprises and individuals to consciously abide by the law and reduce the burden of minor violations caused by non subjective intent.
Since the beginning of this year, Dayaowan Customs has accurately applied the administrative penalty policy of "exemption from punishment for initial violations", continuously optimized the business environment at the port, stimulated the vitality of market entities, and assisted the development of private foreign trade enterprises.
According to statistics, in the first 10 months of this year, Dayaowan Customs has lawfully applied the policy of "exemption from punishment for initial violations" to 65 domestic consignees and shippers, effectively incentivizing foreign trade enterprises to operate in accordance with the law and regulations.
