Yantai Customs seizes export infringing second-hand bulldozers
Recently, Yantai Customs under Qingdao Customs seized second-hand bulldozers for export infringement.
Customs officers found one second-hand bulldozer with the "SHANTUI" logo in a batch of exported goods during inspection. Due to the inability of the shipper to provide proof of authorized use of the relevant trademark, the customs immediately suspended the clearance of the bulldozer and initiated the intellectual property rights verification process. Confirmed by the relevant rights holder, the bulldozer is an infringing product. At present, the customs have lawfully taken administrative detention measures against the bulldozer.
According to Article 44 and Article 91 of the Customs Law of the People's Republic of China, the customs shall protect intellectual property rights related to inbound and outbound goods in accordance with laws and administrative regulations. Those who violate the provisions of this Law by importing or exporting goods that infringe on intellectual property rights protected by laws and administrative regulations shall have the infringing goods confiscated by the customs in accordance with the law and fined accordingly; Those who commit crimes shall be held criminally responsible in accordance with the law.
