India makes final ruling on second anti-dumping sunset review of China's fluororubber

On October 29, 2025, the Indian Ministry of Commerce and Industry issued an announcement, making a positive final ruling on the second anti-dumping sunset review of Fluoroelastomers (FKM) originating from or imported from China, recommending the continued imposition of anti-dumping duties for a period of 5 years, with a tax amount ranging from 1.04 to 8.86 US dollars per kilogram, as follows: Daikin Fluorochemicals (China) Co., Ltd. has a tax amount of 1.04 US dollars per kilogram, Zhonghao Chengguang Research Institute of Chemical Industry Co., Ltd. has a tax amount of 1.30 US dollars per kilogram, and Chengdu Chengguang Boda Rubber Co., Ltd. The price for Chenguang Fluoro and Silicone Elastomers Co., Ltd. is 3.85 US dollars per kilogram, while for other Chinese manufacturers it is 8.86 US dollars per kilogram. The products involved in the case are fluororubber, including copolymer fluororubber, ternary copolymer fluororubber, copolymer rubber, copolymer premix rubber, ternary bisphenol curable rubber, ternary peroxide curable rubber, and ternary bisphenol curable rubber, but do not include fluororubber compounds and perfluoroether rubber (FFKM). The Indian customs codes for the products involved are 39045090, 39046990, 39049090, and 39046910.

On January 2, 2018, India initiated an anti-dumping investigation into fluororubber originating from or imported from China. On December 27, 2018, India made a positive final ruling on the case. On January 28, 2019, the Indian Ministry of Finance issued Notice No. 6/2019 Custod (ADD), deciding to impose anti-dumping duties on Chinese products involved in the case, with a tax amount of 0.078-7.31 US dollars per kilogram, effective immediately. The validity period is 18 months, ending on July 27, 2020 (after which the validity period of the measures is extended to October 27, 2020).

On February 7, 2020, the Indian Ministry of Commerce and Industry announced that it had initiated the first anti-dumping sunset review investigation on fluororubber originating from or imported from China, in response to an application submitted by Indian domestic enterprise Gujarat Fluorochemicals Ltd. On October 19, 2020, the Indian Ministry of Commerce and Industry made its first affirmative final ruling on the case. On November 27, 2020, the Indian Ministry of Finance issued Notice No. 40/2020 Cos (ADD), deciding to continue imposing anti-dumping duties on Chinese products involved in the case, with a tax amount of 1.04-8.86 US dollars per kilogram, and the measures will be effective until November 27, 2025 (now extended to February 26, 2026). On June 16, 2025, the Indian Ministry of Commerce and Industry announced that it would initiate a second anti-dumping sunset review investigation on fluororubber originating from or imported from China, in response to an application submitted by Indian domestic enterprise Gujarat Fluorochemicals Limited. The dumping investigation period of the case is from January 1, 2024 to December 31, 2024, and the injury investigation period is from 2021 to 2022, 2022 to 2023, 2023 to 2024, and January 1, 2024 to December 31, 2024.
